TERMS AND DEFINITIONS

​

​THE FOLLOWING TERMS SHALL HAVE THE MEANINGS ASSIGNED TO THEM FOR THIS CONTRACT HIRE AGREEMENT (“AGREEMENT”) BETWEEN SIGNATURE MARK TOURS AND THE HIRER, UNLESS THE CONTEXT OTHERWISE REQUIRES:

"SIGNATURE MARK TOURS," "COMPANY," "WE," "US," OR "OUR"

MEANS SIGNATURE MARK TOURS LIMITED, THE PROVIDER OF COACH HIRE AND TRANSPORT SERVICES, OPERATES UNDER THE LAWS OF THE UNITED KINGDOM.

"HIRER," "CLIENT," "YOU," OR "YOUR"

THE INDIVIDUAL, COMPANY, GROUP, OR ORGANISATION RESPONSIBLE FOR BOOKING THE COACH SERVICE AND REPRESENTING ALL PASSENGERS ON THE VEHICLE IS REFERRED TO.

"RESPONSIBLE PERSON"

WHERE THE HIRER IS A COMPANY, GROUP, OR PARTNERSHIP, THIS IS THE INDIVIDUAL APPOINTED BY THE HIRER TO ACT AS THE MAIN POINT OF CONTACT AND RESPONSIBLE PARTY FOR THE BOOKING AND THE PASSENGERS.

"CONTRACT" OR "AGREEMENT"

MEANS THE LEGALLY BINDING ARRANGEMENT BETWEEN SIGNATURE MARK TOURS AND THE HIRER FOR THE PROVISION OF COACH HIRE SERVICES, COMPRISING THESE TERMS AND CONDITIONS, BOOKING CONFIRMATION, AND ANY RELEVANT SCHEDULES.

"COACH HIRE" OR "HIRE"

MEANS THE PROVISION OF A COACH AND DRIVER BY SIGNATURE MARK TOURS FOR THE AGREED PERIOD, ROUTE, AND ITINERARY.

​

"VEHICLE" OR "COACH"

MEANS THE MOTOR COACH, MINIBUS, OR SIMILAR VEHICLE SUPPLIED BY SIGNATURE MARK TOURS FOR THE TRANSPORTATION OF PASSENGERS DURING THE HIRE PERIOD.

 

"DRIVER"

MEANS THE QUALIFIED AND LICENSED INDIVIDUAL SUPPLIED BY SIGNATURE MARK TOURS TO OPERATE THE COACH THROUGHOUT THE HIRE.

CONTRACT

​

THESE CONDITIONS APPLY WHETHER A CONTRACT HAS BEEN MADE VERBALLY OR IN WRITING. THE HIRER ACTS ON BEHALF OF ALL THE PASSENGERS TRAVELLING ON THE VEHICLES. IF THE HIRER IS A COMPANY, GROUP, OR PARTNERSHIP, AN INDIVIDUAL MUST BE APPOINTED AS A RESPONSIBLE PERSON. THE HIRER IS RESPONSIBLE FOR THE ACTIONS AND DECISIONS OF ALL THE PASSENGERS ON BOARD, INCLUDING ANY ADDITIONAL COSTS INCURRED IN PERFORMING THE CONTRACT, WHETHER OR NOT THEY ACTUALLY TRAVEL WITH THE PARTY. SIGNATURE MARK TOURS WILL ONLY ACCEPT INSTRUCTIONS FROM THE HIRER. IF THE HIRER IS NOT GOING TO TRAVEL WITH THE PARTY, A REPRESENTATIVE MUST BE CHOSEN, AND THE COMPANY/PARTY MUST BE INFORMED PRIOR TO THE HIRE TAKING PLACE. SIGNATURE MARK TOURS MUST BE ABLE TO IDENTIFY THE INDIVIDUAL IN CHARGE AT THE TIME OF THE HIRING SO THAT THE DRIVER CAN DISCUSS ANY ARRANGEMENTS NECESSARY.

ALL QUOTATIONS ARE GIVEN SUBJECT TO SIGNATURE MARK TOURS HAVING A SUITABLE VEHICLE AVAILABLE AT THE TIME THE HIRER ACCEPTS THE QUOTATION.

​

SIGNATURE MARK TOURS CANNOT GUARANTEE THE HIRER A SPECIFIC BRAND AND MAKE OF COACHES, SUBJECT TO AVAILABILITY ONCE THE HIRER ACCEPTS THE QUOTATION.

​

OUR QUOTATIONS ARE BASED ON LEAD TIME, COACH SIZE, AND THE MOST DIRECT AND SUITABLE ROUTES (*UNLESS SPECIFIED BY THE HIRER USING THE PERSONALISED JOURNEY PLANNER*). ALL OUR QUOTATIONS ARE VALID FOR 7 WORKING DAYS FROM THE DATE OF ISSUE, UNLESS OTHERWISE NOTIFIED.

IF THE HIRER CANCELS THE FIRST QUOTATION AND WOULD LIKE TO USE OUR SERVICE AFTER 7 WORKING DAYS, CLIENTS CAN EXPECT A PRICE FLUCTUATION—SUBJECT TO THE AVAILABILITY OF VEHICLES ON THE DAY OF HIRE/QUOTE.

DAY TOUR: QUOTATIONS ARE GIVEN FOR COACH AND DRIVER ONLY. PLEASE NOTE, DEPENDING ON THE JOURNEY, THE QUOTATION PRICE DOES NOT INCLUDE CHARGES FOR TOLLS, CITY PERMITS, FERRY CHARGES, OR DRIVER FACILITY CHARGES (MEALS AND ACCOMMODATION).

​

UK AND EUROPEAN TOURS: QUOTATIONS ARE GIVEN FOR COACH AND DRIVER, TOLL CHARGES, CITY PERMITS, FERRY TRANSFER CHARGES, DRIVER FACILITY CHARGES (MEALS AND ACCOMMODATION) ON TOURS MORE THAN ONE DAY, AND ANY OTHER APPLICABLE CHARGES. DEPENDING ON THE HIRER'S ITINERARY, QUOTATIONS ARE SUBJECT TO FLUCTUATION.

SIGNATURE MARK TOURS OFFICES DO NOT OPERATE DURING WEEKENDS AND BANK HOLIDAYS. ANY FURTHER CRUCIAL INFORMATION MUST BE GIVEN IN ADVANCE. ALL EMAILS AND VOICEMAILS ARE CHECKED OUTSIDE OFFICE HOURS, AND WE MAY CONTACT YOU DURING THIS TIME TO EITHER CONFIRM OR GATHER MORE INFORMATION.

SIGNATURE MARK TOURS OPERATION DURING PUBLIC HOLIDAYS WILL HAVE ADDITIONAL CHARGES, AND ANY CANCELLATIONS OF VEHICLE HIRE ON PUBLIC HOLIDAYS ARE NON-REFUNDABLE UNDER ANY CIRCUMSTANCES.

​BOOKINGS & PAYMENTS

​

​A PARTIAL PAYMENT CAN BE MADE AS A DEPOSIT, AND A FINAL PAYMENT MUST BE MADE 48 HOURS PRIOR TO THE START OF YOUR JOURNEY.

 

A FULL PAYMENT IS REQUIRED AT THE TIME OF THE BOOKING. PLEASE NOTE THAT THE HIRE IS NOT CONFIRMED IF FULL PAYMENT IS NOT RECEIVED PRIOR TO THE JOURNEY START DATE.

 

PAYMENT METHODS CAN BE MADE VIA BANK TRANSFER.

PAYMENTS MUST BE MADE WITHIN 48 HOURS OF CONFIRMING THE QUOTATIONS UNLESS SIGNATURE MARK TOURS HAS AGREED TO EXTEND THE FINAL PAYMENT DATE. SIGNATURE MARK TOURS CAN ONLY EXTEND PAYMENTS FOR AN ADDITIONAL 24 HOURS; FAILURE TO DO SO CAN LEAD TO CANCELLATION OF THE HIRE AND A PARTIAL REFUND.

CONFIRMATIONS: ONCE THE PAYMENTS ARE COMPLETED AND THE HIRE IS CONFIRMED, SIGNATURE MARK TOURS WILL SEND THE HIRER A FINAL HIRE CONFIRMATION, WHICH YOU ARE REQUIRED TO SIGN AND RETURN BACK TO US.

IT IS THE HIRER'S RESPONSIBILITY TO INFORM ALL THE PASSENGERS ABOUT THE TERMS AND CONDITIONS OF THE HIRE, LUGGAGE HANDLING, AND CODE & CONDUCT ON BOARD SIGNATURE MARK TOURS.

​

BOOKINGS AND INFORMATION EXCHANGE: THE CLIENT IS COMPLETELY RESPONSIBLE FOR PROVIDING SIGNATURE MARK TOURS ALL THE PRECISE AND ACCURATE INFORMATION AT THE TIME OF BOOKING. ANY BOOKINGS MADE WITH SIGNATURE MARK TOURS WILL BE DISREGARDED IF THE CLIENT HAS FAILED TO PROVIDE ANY DETAILS. SIGNATURE MARK TOURS WILL NOT BE LIABLE FOR ANY FINANCIAL REGRESS FOR THE ISSUES ARISING FROM ANY EVENT WHERE THE CLIENT HAS FAILED TO PROVIDE CORRECT INFORMATION. ANY AMENDMENTS TO A CONFIRMED BOOKING FROM CLIENTS WILL BE SUBJECT TO APPLICABLE CHARGES, WHICH ARE REQUIRED TO BE PAID PRIOR TO THE HIRE; FAILURE TO DO SO WILL RESULT IN CANCELLATION OF THE BOOKING WITHOUT ANY FURTHER LIABILITY TO THE COMPANY (SIGNATURE MARK TOURS), AND APPROPRIATE CANCELLATION CHARGES WILL APPLY.

CANCELLATIONS INCLUDING FEES & CHARGES

​

SHOULD YOU NEED TO CANCEL YOUR BOOKING, YOU SHOULD CONTACT US VIA EMAIL (INFO@SIGNATUREMARKTOURS.COM) AND OVER THE PHONE (+44 (0) 7513 846 746) TO TELL US ABOUT THE CANCELLATION AND THEN FOLLOW THIS UP IN WRITING. OUR CANCELLATION CHARGES ARE AS SHOWN IN THE TABLE BELOW:

 

PERIOD PRIOR DEPARTURE WITHIN WHICH WRITTEN NOTICE IS RECEIVED, AMOUNT OF CANCELLATION SHOWN AS PERCENTAGE OF THE TOTAL HIRE COST

  • MORE THAN 7 DAYS, DEPOSIT ONLY.

  • FEWER THAN 7 DAYS BUT NOT MORE THAN 48 HOURS: 50% OF THE TOTAL COST OF THE HIRE.

  • LESS THAN 48 HOURS, 100% OF THE TOTAL COST OF THE HIRE.

 

CANCELLATION DUE TO SEVERE WEATHER CONDITIONS THAT IMPOSE RISKS TO OUR DRIVERS AND CUSTOMERS, SIGNATURE MARK TOURS RETAINS THE RIGHT TO CANCEL 

 

GENERAL TERMS AND CONDITIONS

CLIENTS ARE REQUIRED TO IDENTIFY AND COMMUNICATE IF THE HIRE IS FOR A SPECIFIC OCCASION AND HAS ANY OTHER SPECIAL REQUIREMENT.

IN ADDITION, THE COST OF ANY ACCOMMODATION, MEALS, THEATRE TICKETS, AND FERRY AND/OR SHUTTLE COSTS THAT HAVE ALREADY BEEN PURCHASED BY SIGNATURE MARK TOURS WILL BE CHARGED TO THE HIRER, PLUS ANY ADMINISTRATION CHARGES INCURRED BY SIGNATURE MARK TOURS.

THE DRIVERS RETAIN FINAL DISCRETION OVER THE PICK-UP AND SET-DOWN LOCATION IN COMPLIANCE WITH THE ROAD TRAFFIC ACT 1991 AND LOCAL RESTRICTIONS AT THE TIME OF THE JOURNEY. SHOULD THE HIRER, OR ANY PERSON CLAIMING TO REPRESENT THE HIRER, INSIST THAT PASSENGERS ARE PICKED UP/SET DOWN IN A LOCATION NOT APPROVED BY THE DRIVER, THE HIRER AGREES TO PAY ANY PARKING/TRAFFIC VIOLATION PENALTY OR FINE. THIS MAY BE INCURRED, AND AGREES THAT IT WILL REIMBURSE SIGNATURE MARK TOURS WITHIN 7 DAYS OF RECEIPT.

RED ROUTE AND RESTRICTIONS: IT IS THE HIRER’S RESPONSIBILITY TO ENSURE THAT ANY PICKUPS/DROPOFFS/STOPOVERS ARE NOT ON THE RED ROUTE. ANY FINES ARISING IN AN EVENT WHERE THE HIRER HAS FAILED TO COMMUNICATE THIS, RESULTING IN TRAFFIC FINES, THE HIRER IS REQUIRED TO PAY THE FINES TO SIGNATURE MARK TOURS. WILL NOT BEAR THE COST OF PARKING TICKETS.

FINAL ITINERARIES MUST BE PROVIDED TO US WITHIN 24 HOURS PRIOR TO THE DEPARTURE DATE. FAILURE TO DO SO CAN RESULT IN SIGNATURE MARK TOURS CANCELLING THE BOOKING WITHOUT ANY FURTHER LIABILITY AND AT AN APPROPRIATE CANCELLATION CHARGE. THE HIRER AGREES TO BEAR ANY COSTS ARISING DUE TO FAILURE TO PROVIDE UP-TO-DATE AND ACCURATE ITINERARIES ON TIME.

​

PLEASE NOTE THAT NO REFUNDS WILL BE PROCESSED IF THE AIRPORT PICKUPS ARE NOT DONE ON TIME DUE TO FLIGHT DELAYS. THE

RE-HIRE IS SUBJECT TO AVAILABILITY; SIGNATURE MARK TOURS WILL NOT BE LIABLE FOR ISSUES ARISING DUE TO THE NON-AVAILABILITY OF COACHES.

ANY NOTICE OF CHANGE, WHATSOEVER, TO BE GIVEN BY EITHER PARTY TO THE OTHER UNDER THE EXISTING CONDITIONS SHALL BE IN WRITING/EMAIL, AND ACKNOWLEDGEMENT MUST BE SENT OF NOTICE BY THE INITIATOR IN WRITING/EMAIL.

BREAKDOWNS

​​

Any advice on journey time which the operator gives is given in good faith. However, the hirer agrees that the operator cannot be held responsible for any failure to meet any published journey schedule and or itinerary as a result of breakdown or traffic congestion or any other event beyond the reasonable control of the
operator.

​

WE GIVE ADVICE ON JOURNEY TIMES IN GOOD FAITH, BUT WE CANNOT GUARANTEE THE COMPLETION OF ANY JOURNEY AT A SPECIFIC TIME AND WILL NOT BE LIABLE FOR LOSS OR INCONVENIENCE CAUSED BY BREAKDOWN, TRAFFIC CONGESTION, OR OTHER DELAY OUTSIDE OUR CONTROL.

​

VEHICLE TO BE PROVIDED

​​

For the purposes of these conditions, ‘vehicle’ shall be defined as the coach, bus, minibus or other road vehicle provided by the operator and/or the operator’s servants or agents (including vehicles supplied by a third party) to convey anyone travelling on any of the operator’s services.

​

 The operator reserves the right to substitute another vehicle or other vehicles (including those of a third party) or ancillary facilities for all or part of the hiring, subject to such substitutes being of at least an equivalent standard.

​

The operator reserves the right to provide a larger vehicle than specified at no additional charge unless any extra seats are used in which case an additional pro rata charge will be added to the hire charge.

​

WHILST EVERY EFFORT SHALL BE MADE TO SUPPLY AN EXECUTIVE OR STANDARD LUXURY COACH, SOMETIMES SUCH VEHICLES BECOME UNAVOIDABLY UNAVAILABLE. IN SUCH CASES, WE SHALL SUPPLY THE HIGHEST STANDARD OF VEHICLE AVAILABLE TO US AT THE TIME, INCLUDING THOSE OF OTHER OPERATORS, FOR ALL OR PART OF THE HIRE. WE RESERVE THE RIGHT TO PROVIDE A LARGER VEHICLE THAN THAT SPECIFIED AT NO EXTRA CHARGE UNLESS ANY ADDITIONAL SEATS ARE USED, IN WHICH CASE AN ADDITIONAL PRO RATA CHARGE WILL BE MADE.

In the event that any journey takes longer than predicted or scheduled, the hirer expressly agrees that the operator will not be liable to the hirer or the hirer’s passengers for any loss or inconvenience suffered by the hirer or the hirer’s passengers as a result.

​


SEATING CAPACITY

​​

The hirer must not load any vehicle beyond the number of passengers which it is legally permitted to carry.

​

The operator will only agree to carry passengers under the age of 18 years if such carriage has been expressly confirmed in writing by the operator at least 7 days before the date when the carriage is due to take place. Under no circumstances will children under the age of 14 be carried unless accompanied by an adult.

​

WE WILL, AT THE TIME OF CONFIRMING YOUR HIRE, CONFIRM THE SEATING CAPACITY OF THE VEHICLE TO BE SUPPLIED. NO MORE THAN THE MAXIMUM NUMBER OF PASSENGERS INDICATED MAY BE CARRIED ON EACH VEHICLE.

​

At the time of booking, the operator will agree and specify the legal seating capacity of the vehicle to be supplied. The hirer must not load the vehicle beyond this capacity. Under no circumstances may any courier seat be used by the hirer and or the hirer’s passengers.

​

USE OF VEHICLE UNLESS WE HAVE AGREED OTHERWISE IN WRITING IN ADVANCE, THE VEHICLE SHOULD NOT BE ASSUMED TO REMAIN AT ANY POINT BETWEEN THE OUTWARD AND RETURN JOURNEY NOR TO REMAIN AVAILABLE FOR YOUR INCIDENTAL USE WHEN PARKED AT SUCH POINTS.

 

 


ROUTE OR TIME VARIATIONS

WE RESERVE THE RIGHT TO MAKE AN ADDITIONAL CHARGE FOR ANY ADDITIONAL MILEAGE OR TIME INCURRED OVER AND ABOVE THAT AGREED IN THE HIRE. ANY ADDITIONAL CHARGES WILL BE COMMENSURATE WITH THE COSTS INCURRED BY US.

THE VEHICLE WILL DEPART AT TIMES AGREED WITH YOU, AND IT IS YOUR RESPONSIBILITY TO ACCOUNT FOR ALL PASSENGERS AT THESE TIMES. WE WILL NOT ACCEPT ANY RESPONSIBILITY FOR ANY LOSSES INCURRED BY PASSENGERS WHO FAIL TO FOLLOW YOUR INSTRUCTIONS.

THE HOURS AGREED FOR YOUR COACH HIRE BOOKING MUST BE OBSERVED (OTHER THAN IN THE CASE OF SERIOUS EMERGENCY OR DIVERSION) SO THAT CURRENT REGULATIONS GOVERNING DRIVERS’ HOURS AND REST PERIODS MAY BE COMPLIED WITH. UNDER NO CIRCUMSTANCES WILL WE ALLOW YOUR COACH HIRE TO EXCEED THESE REGULATED HOURS.

CHANGES TO ITINERARY

​

FROM TIME TO TIME, SIGNATURE MARK TOURS MAY HAVE TO CHANGE CERTAIN ASPECTS OF THE GIVEN ITINERARY. WHEREVER POSSIBLE, SUCH CHANGES SHALL BE NOTIFIED TO YOU IN ADVANCE.

PASSENGERS' BELONGINGS

​

ALL VEHICLES LISTED ARE SUBJECT TO RESTRICTIONS ON CARRYING LUGGAGE FOR STATUTORY SAFETY REASONS. THE DRIVER HAS FULL DISCRETION AS TO THE CARRIAGE OF PASSENGERS’ LUGGAGE AND ITS STORAGE. GENERALLY, ONE SUITCASE PLUS ONE SMALL PIECE OF HAND BAGGAGE PER PERSON WILL BE ACCOMMODATED. WE DO NOT ACCEPT LIABILITY FOR ANY DAMAGE TO OR LOSS OF ANY PROPERTY THAT BELONGS TO PASSENGERS AND IS LEFT IN THE VEHICLE. ALL ARTICLES OF LOST PROPERTY RECOVERED FROM A VEHICLE WILL BE HELD AT THE DEPOT AT WHICH THE VEHICLE IS BASED FOR THREE MONTHS AND WILL THEN BE DESTROYED.

PASSENGER CONDUCT

​​

All vehicles hired by the Hirer are subject to restrictions on carrying luggage for statutory safety reasons. The hirer accepts that the driver shall be the sole judge as to whether and to what extent passengers’ property is carried. Large bulky items may not be able to be carried, and the hirer should take steps to notify the company in advance of such requirements.​

​

Only lightweight items may be placed in the overhead rack and passengers are asked to place briefcases and other property of that nature on the floor within their seat space. Where space allows, large items of luggage will be accommodated in the under floor or rear lockers on request to the driver.

 

Please note that nothing may be allowed to obstruct the gangways or exits and very large quantities of luggage may not be carried except by prior arrangement.

Please note that smoking & alcohol are not permitted on any of Signature Mark Tours Vehicles. 

​

The driver is responsible for the safety of the vehicle at all times, and as such may remove any passenger at the driver’s absolute discretion including those whose behaviour prejudices safety or is in breach of the Public Service Vehicle (Conduct o Drivers, Inspectors, Conductors and Passengers) Regulations 1990 as amended.

​

In addition to condition above it is agreed by the hirer that any of Signature Mark Tours' management or supervisory staff shall be empowered to require a passenger to leave a coach should their behaviour be a danger to themselves a danger or a nuisance to other passengers, or a danger to other road users. Such behaviour shall include consumption of alcohol, noise from any other instrument, radio or recorded sound player, unpleasant language or threatening behaviour.

IN THE INTEREST OF OTHER PASSENGERS, NO MUSICAL INSTRUMENTS, RADIOS, AND/OR OTHER AUDIO DEVICES SHALL BE PLAYED WITHOUT THE COMPANY’S PERMISSION. SUCH PERMISSION SHALL BE SHOWN ON THE CONFIRMATION, WHERE AGREED, OR AT THE DISCRETION OF THE DRIVER.

 

The hirer and or the hirer’s passengers are required to notify Signature Mark Tours in the event that they wish to carry any wheelchair of whatever type or size such notification to include details of the height, width and depth dimensions and the weight of the wheelchair as well as details as to the extent to which the wheelchair is capable of being dismantled. We will then investigate whether we can carry the specified wheelchair and will confirm the conditions, if any, under which we agree to transport it. Notification by the hirer under this condition must be provided to Us before any booking is made.

IT IS STRICTLY FORBIDDEN FOR ANY PERSON TO CARRY OR CONSUME DRUGS OF ANY DESCRIPTION EXCEPT WHERE SUCH DRUGS ARE LEGALLY AVAILABLE OVER THE COUNTER WITHOUT PRESCRIPTION OR ARE PRESCRIBED BY A DOCTOR. YOU MAY BE REQUIRED TO PRODUCE MEDICAL EVIDENCE, ESPECIALLY WHEN LEAVING OR ENTERING COUNTRIES.

 

THE DRIVER IS RESPONSIBLE FOR THE SAFETY OF THE VEHICLE. ANY PASSENGER WHOSE CONDUCT IS IN BREACH OF STATUTORY REGULATIONS OR IS ABUSIVE TO ANY PERSON MAY BE REMOVED ON THE DRIVER’S AUTHORITY. YOU WILL BE HELD RESPONSIBLE FOR THE CONDUCT OF PASSENGERS AND FOR ANY DAMAGE CAUSED TO THE VEHICLE BY PASSENGERS DURING THE HIRE. WE WILL NOT ACCEPT LIABILITY FOR DAMAGE OR LOSS TO ANY PASSENGER ENTERING OR LEAVING THE COACH WHILST IN MOTION.

 

UNDER NO CIRCUMSTANCES MAY ALCOHOLIC DRINKS BE CARRIED OR CONSUMED ON A VEHICLE WITHOUT OUR PERMISSION. IT IS ALSO ILLEGAL TO CARRY OR CONSUME ALCOHOLIC DRINKS ON A COACH PROCEEDING TO OR FROM DESIGNATED SPORTING EVENTS, AND PERMISSION CANNOT BE GIVEN IN THIS CASE. NO ANIMALS (OTHER THAN GUIDE DOGS AND HEARING DOGS NOTIFIED TO US IN ADVANCE) MAY BE CARRIED ON ANY VEHICLE WITHOUT OUR PRIOR WRITTEN AGREEMENT.

 

NO BILL, POSTER, OR NOTICE IS TO BE DISPLAYED ON ANY VEHICLE WITHOUT OUR PRIOR WRITTEN CONSENT.

 

The hirer is responsible for any nuisance or damage to the vehicle including but not limited to liquid spillages and vomit caused or contributed to by the hirer and or any passenger on whose behalf the hirer has booked passage on any of the operator’s services for the duration of the period of hire.

SICKNESSES ON BOARD COACHES: SIGNATURE MARK TOURS RESERVES THE RIGHT TO IMPOSE A CLEANING CHARGE OF UP TO £300.00 PLUS VAT IN ANY CASE OF SICKNESS AFFECTING THE COACH. FOR SCHOOLS, A STANDARD CLEANING CHARGE OF £300.00 PLUS VAT WILL APPLY IN THESE CASES. ANY INFRINGEMENT OF THESE CONDITIONS COULD RENDER YOUR HIRE WITH SIGNATURE MARK TOURS TERMINATED WITHOUT REFUND OR COMPENSATION.​

Where the hire is to a sporting event, the hirer should be aware of the legal requirements relating to alcohol, contained in the Sporting Events (Control of Alcohol) Act 1985 (as amended) and the conditions of entry to race courses as laid down by the Race Course Association Ltd. 

​

​It is a strict term of these conditions that the hirer and the hirer’s passengers shall at all times during any journey which is subject to these conditions take all reasonable steps to avoid causing damage to any of the operator’s vehicles. The hirer agrees that the operator and or the operator’s driver(s) shall be permitted to require any passenger or passengers to leave the vehicle in the event of their failure to take all reasonable steps to avoid causing damage to any of the operator’s vehicles.

 

PASSENGERS ARE EXPECTED TO MAINTAIN CLEANLINESS AND RESPECT FOR THE COACH AT ALL TIMES. UNTIDY BEHAVIOUR, INCLUDING LITTERING, SPILLING FOOD OR DRINKS, OR LEAVING THE COACH IN AN UNCLEAN CONDITION, IS STRICTLY PROHIBITED. ANY ACTS OF VANDALISM, DAMAGE, OR DELIBERATE MISUSE OF THE VEHICLE OR ITS EQUIPMENT WILL NOT BE TOLERATED. PASSENGERS FOUND ENGAGING IN SUCH BEHAVIOUR MAY BE REMOVED FROM THE COACH IMMEDIATELY AND COULD BE HELD FINANCIALLY RESPONSIBLE FOR ANY REPAIRS OR CLEANING COSTS INCURRED.

 

LOST PROPERTY​

 

The operator will not accept liability for any damage to or loss of any property left on a vehicle by a passenger.

​

All articles of lost property recovered from the vehicle will be held at the operator’s premises where the vehicle is based and will be subject to the current Public Service (Lost Property) Regulations, as amended. 

​

Signature Mark Tours accepts no liability for any personal property of the hirer or the hirer’s passengers, and it is the responsibility of the hirer and the hirer’s passengers to take all reasonable steps to avoid loss or damage. The hirer should notify Signature Mark Tours or the driver if items of exceptional value are to be carried on the vehicle. It is the hirer’s responsibility to minimise the risk of loss if property is left unattended.

It is the responsibility of the hirer to ensure that the property of the hirer and the hirer’s passengers are fully insured separately for loss and or damage.

​

WHITE LABEL SERVICE​

 

No bill, poster or notice is to be displayed on any vehicle without the prior written consent of the operator.

CHILDREN & YOUNG INFANTS

​

SIGNATURE MARK TOURS DOES NOT PROVIDE CAR SEATS ON ANY OF OUR VEHICLES. BUT PASSENGERS SHOULD CARRY CAR SEATS WITH TRAVELLING INFANTS FOR COMFORT AND SAFETY. PASSENGERS CAN PLACE PUSHCHAIRS AND BUGGIES (DEPENDING ON THE SIZE) IN THE BAGGAGE LOCKER OF VEHICLES.

IN MOST OF EUROPE, THE USE OF CHILD SEATS IN COACHES IS MANDATORY FOR CHILDREN. A CHILD SEAT WITH A HARNESS OR A RESTRAINT SYSTEM. CHILDREN BETWEEN 7 AND 12 YEARS OLD OR BETWEEN 125 AND 150 CM TALL MUST USE A BOOSTER SEAT OR A SEAT CUSHION. IT IS THE RESPONSIBILITY OF THE CHILD'S PARENT OR GUARDIAN TO PROVIDE THE APPROPRIATE CHILD SEAT FOR THEIR CHILD.

CURRENCY & PASSPORTS

IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOU ARE CARRYING THE CORRECT CURRENCY FOR EACH COUNTRY VISITED ALONG WITH A CURRENT VALID PASSPORT AND APPROPRIATE VISAS FOR SUCH COUNTRIES.

DUTY-FREE & DUTY-PAID GOODS:IT IS THE HIRING PARTY'S/HIRER'S COMPANY'S (TOUR OPERATORS/TRAVEL AGENCIES) RESPONSIBILITY ALONE TO ENSURE THAT YOU REMAIN WITHIN THE CURRENT LAWS AND REGULATIONS IN REGARD TO DUTY-FREE AND DUTY-PAID REGULATIONS. SIGNATURE MARK TOURS SHALL NOT ACCEPT RESPONSIBILITY FOR ANY DELAY OR CONFISCATION OF GOODS WHATSOEVER. COPIES OF THESE REGULATIONS ARE OBTAINABLE FROM EVERY PLACE OF DEPARTURE FROM GREAT BRITAIN. THE DRIVER SHALL DECIDE ON THE AMOUNT OF HEAVY GOODS THAT THE COACH CAN LEGALLY CARRY. THE DRIVERS’ DECISION IS FINAL.

 

 


TRAVEL INSURANCE / NON-UK TRAVEL

IT IS NOT COMPULSORY TO TAKE OUT TRAVEL INSURANCE, ALTHOUGH WE HIGHLY RECOMMEND THAT YOU DO, ESPECIALLY WHEN TRAVELLING OUTSIDE OF THE UNITED KINGDOM. PLEASE NOTE THAT IT IS YOUR RESPONSIBILITY ALONE TO ENSURE THAT YOU ARE INSURED ADEQUATELY AND THAT YOU HAVE THE CORRECT TRAVEL DOCUMENTS WHEN TRAVELLING OUTSIDE OF THE UNITED KINGDOM.

TRAVEL OUTSIDE THE UNITED KINGDOM 

​

For British citizens a full 10-year passport is required. Non-British nationals are advised to contact their own embassy in order to check what documents are required for entering Europe. The operator will not be responsible to or for any passengers who travel with incorrect travel documents.

​

On continental shopping trips, to comply with weight and space restrictions, each passenger is restricted to carrying a maximum of subject to there being sufficient room and carrying capacity available. The driver shall have absolute discretion to decide what luggage and/or purchases any passenger may carry on the vehicle at any time. ( NOTE: REFER TO DUTY FREE CLAUSE AND/OR UK DUTY FREE REGULATIONS)

COMPLAINTS PROCEDURE

WE CAN NORMALLY REACH AN AMICABLE AGREEMENT ON THE FEW COMPLAINTS THAT WE RECEIVE. SHOULD YOU HAVE ANY REASON TO COMPLAIN DURING THE HIRE, YOU SHOULD FIRSTLY NOTIFY THE DRIVER OR OUR REPRESENTATIVE, WHO WILL ENDEAVOUR TO RECTIFY THE PROBLEM FOR YOU.

IF THAT MATTER CANNOT BE RECTIFIED TO YOUR SATISFACTION, DETAILS OF THE COMPLAINT SHOULD BE MADE IN WRITING WITHIN 14 DAYS OF THE HIRE TO:

WE WILL ACKNOWLEDGE ALL COMPLAINTS WITHIN 14 DAYS AND WILL NORMALLY REPLY WITHIN 28 DAYS.

CONTRACT

​

THE CONTRACT BETWEEN US IS DEFINED BY THESE BOOKING TERMS AND CONDITIONS AND OUR WRITTEN CONFIRMATION FOLLOWING RECEIPT OF YOUR DEPOSIT. THIS CONTRACT IS GOVERNED BY THE LAWS OF ENGLAND AND WALES, THE COURTS OF WHICH HAVE EXCLUSIVE JURISDICTION IN RELATION TO THIS CONTRACT.

OUR RESPONSIBILITIES TO YOU

​

WE SHALL PERFORM THE TERMS OF THE HIRE AS SPECIFIED IN THE CONFIRMATION. WE ACCEPT RESPONSIBILITY FOR ACTS AND/OR OMISSIONS OF OUR EMPLOYEES. WE CARRY FULL INDEMNITY INSURANCE COVER FOR ANY DEATH OR PERSONAL INJURY OF ANY PASSENGER OR THIRD PARTY ARISING AS A RESULT OF THE HIRE.

LEGAL STANDING

 

Any contract made between the operator and the hirer under these conditions shall be considered a contract made in England and Wales shall be governed in all respects.
